Defective Products and Drugs

As consumers, we trust that the products we use each day are safe for us and our families. However, that is not always the case. Serious illness, injury, or even death can be caused by defects in a product's—

  • Design
  • Manufacturing
  • Marketing

Companies may be held liable if they manufactured, sold, supplied, or distributed a dangerous or defective product that caused injuries. If enough people have suffered injuries or illness due to a defective product or drug, they may decide to join together in a class action. At The Law Offices of Rufus R. Smith, Jr. we represent clients in individual lawsuits and class actions.

Products liability in Alabama

According to Alabama law, products liability actions must be filed within two years of the date the injury occurred. In cases where the injury is not discovered before the two-year deadline because it resulted from exposure or ingestion of a harmful substance over time, you have one year from the time that the injury is—or should have been—discovered to file suit.

Have you been injured by a defective product or drug?

If you are injured while using a product:

  • Seek immediate medical attention
  • If possible, preserve the product—including the label and packaging. Do not repair broken products
  • Note the date of your injury
  • Write down the facts relating to the incident and your injury
  • Take photos of your injury
  • Keep copies of any medical records related to your treatment for the injury

Be sure to contact a reputable attorney as soon as possible after you are injured—and before you speak with your insurance company.

Class actions

A class action is a civil lawsuit filed by one or more individuals on behalf of a large group of people. This lifts the burden and expense of a lawsuit off of each individual. Once a judge determines that the plaintiffs have all been injured in a similar way by the same product, one or more people are selected as class representatives. All plaintiffs named in the suit share in any verdict or settlement obtained. People harmed by defective products or drugs often join together in class action suits.
